Travel Agency Terms and Conditions

By booking travel services through us, making a payment, or accepting any travel arrangements, you ("Client," "you," or "traveler") agree to be bound by these Terms and Conditions.
1. Agency Role and Relationship to Suppliers
We act solely as a retail travel agent or intermediary. We do not own, operate, or control any travel suppliers (airlines, hotels, cruise lines, tour operators, car rental companies, etc. – collectively "Suppliers"). All travel services are provided by independent third-party Suppliers under their own contracts, terms, conditions, and limitations of liability.
We do not guarantee the performance, safety, or quality of any Supplier. Your legal recourse is directly against the Supplier, not us.
2. Booking and Confirmation
Bookings are not confirmed until we issue a written confirmation (email/invoice/trip itinerary). All bookings are subject to availability and Supplier acceptance. Prices are subject to change until fully paid and confirmed.
You are responsible for providing accurate information (full names exactly as on passports, dates of birth, etc.). Errors may result in additional fees or denied travel.
3. Payments, Deposits, and Fees
Deposits and final payments are due as specified in your booking confirmation. Failure to pay on time may result in cancellation without refund.
We may charge [insert your fees, e.g., a non-refundable planning/design fee of $XXX, service fees, or trip planning retainer].
All payments are non-refundable except as provided in these terms or required by law.
4. Cancellations, Changes, and Refunds
Most travel products are non-refundable or subject to strict penalties. Cancellation or change fees are governed by the Supplier's terms (which can be up to 100% of the cost).
If you cancel or change plans, you remain liable for all Supplier-imposed fees/penalties. We will assist with refund requests where possible, but refunds depend entirely on the Supplier.
Our own fees (planning, service, retainer, etc.) are non-refundable in all circumstances.
We are not responsible for refunding travel insurance premiums.
5. Travel Insurance – Strongly Recommended
We strongly recommend purchasing comprehensive travel insurance (including trip cancellation/interruption, medical, evacuation, and baggage coverage). Many plans offer "Cancel For Any Reason" (CFAR) coverage.
We may offer quotes, but the decision to purchase (and any claim denials) is your responsibility. We are not liable for any losses not covered by insurance.
6. Limitation of Liability and Release
To the fullest extent permitted by law, we disclaim all liability for:
- Acts, omissions, or negligence of any Supplier
- Injury, death, illness, damage, delay, cancellation, or loss arising from travel
- Changes in itineraries, overbooking, strikes, weather, natural disasters, pandemics, terrorism, government actions, or other events beyond our control ("Force Majeure")
- Financial default or bankruptcy of any Supplier
- Your failure to obtain proper documentation (passports, visas, vaccinations, etc.)
You release and hold us harmless from all claims, damages, or losses related to your travel.
Our total liability (if any) shall not exceed the amount of fees we received from you for the booking.
7. Travel Documents, Health, and Safety
You are solely responsible for obtaining and carrying valid travel documents (passports valid for at least 6 months beyond return date for most countries, visas, etc.), vaccinations, and complying with entry/exit requirements.
We recommend checking U.S. State Department (travel.state.gov), CDC (cdc.gov/travel), and other official sources regularly. Real ID-compliant ID is required for domestic U.S. flights (as of May 2025 onward).
Minors traveling without both parents may require notarized consent forms.
8. Changes or Cancellation by Us or Suppliers
We or Suppliers may cancel or change bookings due to Force Majeure, low participation, or other reasons. In such cases, we will assist with alternatives or refunds per Supplier policy, but we have no further liability.
9. Privacy and Data
We collect personal information to facilitate bookings. By booking, you consent to us sharing your data with Suppliers as needed. See our separate Privacy Policy [link if you have one].
10. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Minnesota. Any disputes shall be resolved exclusively in the courts of Hennepin County, Minnesota.
11. Acceptance
Your booking, payment, or acceptance of travel documents constitutes acceptance of these Terms and Conditions. These terms may be updated; the version in effect at booking applies.
